Bronx Woman Sues Obstetrician for Medical Malpractice and Wins Large Verdict

What type of childbirth related injuries are compensable in a medical malpractice action?

Giving birth to a child is supposed to be one of the happiest moments of a woman’s life. Although most women are inclined to worry, they are urged to place their trust in the medical team they have chosen. Most of the time things run smoothly. But, sometimes women are injured due to medical malpractice that arises during a childbirth related medical procedure. That is exactly what happened to one New York woman in 2009.

Llaulin Cruz of the Bronx was admitted to St. Barnabus Hospital to deliver her daughter. She alleges that during this time her obstetrician, Dr. Michael Ihemaguba, made a number of serious mistakes. Cruz argues that Ihemaguba continued to instruct her to push even after her daughter’s head was out. She also claims that Ihemaguba performed an episiotomy, which is a cut to enlarge the vaginal opening, unnecessarily. Cruz asserts that she knew nothing of this until she delivered her son the next year causing more injury to the surrounding tissue. Cruz asserts that she is almost always in pain and that she will have to suffer for the rest of her life due to Ihemaguba’s mistakes.

Ihemaguba refutes Cruz’s claims and asserts that he made the necessary repairs to her tissue at the time of delivery. But, the jury sided with Cruz. They found that Ihemaguba did commit medical malpractice and that he was 90% at fault for Cruz’s injuries. The jury awarded Cruz $50 million in damages.
