Star Trek Actor's Loved Ones File Wrongful Death Lawsuit Against Automaker

 Personal injury laws are designed to protect us from unreasonably dangerous conduct by others. Sometimes, injuries occur due to another person’s negligent behavior (e.g., driving while intoxicated). Other times, injuries occur due to unreasonably dangerous items or consumer goods – an area of the law known as “products liability.”

In today’s post, we discuss a recent wrongful death lawsuit filed on behalf of beloved Star Trek actor Anton Yelchin – who was fatally crushed by his motor vehicle in his own driveway.

 Wrongful death actions are nearly identical to general personal injury actions, except for the fact the plaintiff must prove that the victim was actually killed by the negligent act as opposed to merely injured. Depending on the state, a wrongful death action may be filed by a surviving immediate family member or the estate of the victim; and plaintiffs can collect on behalf of the victim in an amount determined to be congruent with the harm and defendant’s culpability.

In this case, the 26-year old actor was standing in his drive way when his 2015 Jeep Cherokee inexplicably began driving backwards down the driveway. In essence, the plaintiffs (Yelchin’s parents) assert that the vehicle was so dangerously constructed it should have never been allowed on the roads to begin with. Not to mention, the automaker – Fiat Chrysler – had also recently initiated a recall of the vehicle in question, citing defects in the automatic gear shifter. According to the National Highway Safety Traffic Administration, there have been 41 injuries, 212 collisions and 308 property damage claims as a result of the defect. Due to the problem, drivers are deceived into believing the vehicle is in the Park position, when in fact the vehicle may continue to roll – which is what caused the untimely death of Yelchin. According to reports, he was tragically pinned between his vehicle and a nearby brick pillar, making it impossible for him to break free.
