Justice for School Bus Accident Victims

Q: What compensation can victims of a school bus accident recover?

In New York City, accidents happen all day, every day. So often in fact that news of truck, bus, or car accidents rarely raises an eyebrow. But when a school bus filled with young children has an accident with fatalities, the entire nation rightfully takes notice.

Just before the Thanksgiving break, a tragic school bus accident in Chattanooga Tennessee claimed the lives of at least five elementary school children and injured at least 12 others. One poor family had three daughters on that bus; two were injured but released from the hospital. The other daughter was one of the children that died.

News coverage showed the crash scene with a full-sized school bus lying on its side literally wrapped around a tree. The investigation is ongoing, but police were quick to accuse the driver of driving “recklessly” and at a “high rate of speed” in excess of the speed limit. The driver reportedly just got his commercial driver’s license in April and had a previous “minor bus crash” in September. There were no other vehicles involved in the accident and no reported mechanical issues with the bus cited as yet.

The innocent injured children on board, and the families of those who died as a result of their injuries, are entitled to compensation for their injuries and losses. Of course, nothing can bring their children back or prevent the tragedy, but the victims and their families should not be further burdened by medical and/or funeral expenses and other financial losses incurred as a result of the accident.
