Avoid the Window Table

Q: Who is responsible for patrons’ personal injuries or property damage after a car drives through a store-front?

There’s a new drive-thru pizzeria in the Bronx, New York. At least, that’s how it looked when the dust from the accident had settled.

On the first business day of 2017, Famous Pizza Express on Kappock Street in Riverdale underwent a drastic involuntary renovation.

That afternoon, an automobile accident occurred outside – and inside – the Bronx pizzeria leaving a couple of patrons with personal injuries in its wake. And of course, it left the business owner in urgent need of a serious commercial real estate renovation.

An SUV came barreling through the front and continued all the way into the Italian restaurant. The single car accident injured two patrons inside the restaurant. The driver reportedly drove into the pizzeria while attempting to avoid another driver who was allegedly trying to beat the traffic light.

Personal injury lawsuits can arise when someone is injured by the negligent, reckless, or intentional actions or inactions of someone else.

Compensatory damages in personal injury lawsuits depend on the severity of the injuries and differ from case-to-case. But generally, damages may include monetary compensation for such items as doctors’ and hospital bills related to the accident, future anticipated medical bills, property damage, pain and suffering, current and future lost or diminished income, and more.

It is important to get an experienced personal injury attorney on your side as soon as possible after an accident. An attorney can advise you before you make any statements that could be harmful to your case as well as reconstruct the accident and gather evidence to support your claim. In addition, an attorney can review any insurance company settlement offer and determine if it is fair or can take aggressive legal action if it is inadequate.
