Road Rage Rundown of Rockland County Mom and Kids

Q: Can I sue for personal injuries in a road rage accident?

Automobile accidents are a fact of life, especially in New York City and the surrounding areas. While lucky passengers may escape with minor injuries when they’re protected by a vehicle’s steel frame, such is rarely the case when pedestrians are the victims.

Personal injury lawsuits often arise from pedestrian accidents. In addition, drivers often flee the scene of pedestrian accidents.

A Monsey mom and her three young children were mowed down in what a witness described as a road rage incident. After reportedly being cut off by another vehicle, a man threw a cup out of his car window and alleged "drove erratically" just before he allegedly ran down a mother who was walking with her 13- and 9-year-old children while pushing her three-month-old infant in a stroller along the shoulder of the roadway. The entire family of four was hospitalized with serious injuries from the hit-and-run accident.

A suspect was arrested later that day and reportedly charged with four counts of assault, four counts of reckless endangerment, and one count of reckless driving. A local legislator interviewed after the accident expressed frustration over what he claimed was the city’s lack of response to alleged requests for sidewalks in the area.

In order to prevail in a personal injury action, a victim must prove that the injuries suffered were caused by the negligent, reckless, or intentional actions or inactions of another person or entity.  Once liability is established, compensatory damages may be awarded for items including current and future medical bills, current and future lost income, property damage, pain and suffering, and more depending on the circumstances of each case.
