Bronx Motorcycle Accident Claims Motorcycle Club Co-Founder

Q: Is every death a wrongful death?

There is something particularly tragic, and also ironic, in hearing of a biker dying in a motorcycle accident while he was reportedly returning home from a fallen fellow biker's memorial. Especially when the biker was "very involved in community service and was very loved by everyone".

The Bronx motorcycle accident occurred about 2:00 am when the victim-- who was reportedly traveling home from the memorial along with "approximately 20" members of the Tru 31 Motorcycle Club he co-founded-- rear-ended a sedan and was sent into a guardrail. Reportedly, the sedan driver told police "he panicked when the bikers encircled his vehicle and then abruptly changed lanes." The victim was allegedly killed instantly upon striking the guard rail and pronounced dead at the scene.  The driver has reportedly not been charged.

The Tru 31 Motorcycle Club reportedly wants “to change the perception of motorcycle clubs”, is actively involved in charity fundraisers and community service, and has been working with the 47th Precinct Community Council to "improve police and community relations".

When someone is killed as a result of the negligence, recklessness, or malice of someone else, the victim’s closest surviving relatives may be entitled to compensation through a wrongful death lawsuit. But proving the defendant was liable for the death is a burden on the plaintiff.

Wrongful death lawsuits are complicated with respect to which people have standing to sue and what type of damages they may be entitled to. A skilled personal injury attorney can help you navigate the process.

Generally, wrongful death actions are commenced by the victim’s closest surviving relatives – – usually a spouse, children, or parents-- who are generally the people who may have relied on the victim for financial support and are now suffering economically as well as emotionally. Compensatory damages in a wrongful death action generally include the victim’s final medical and funeral expenses as well as compensation for the survivor’s financial and emotional losses—again, depending on each particular case.

If you or a loved one has been injured, or a loved one has been killed, in any kind of accident, as a result of someone else's negligence, the Goldstein Law Firm can help you take action to recover the compensation to which you are entitled. While we can't bring your loved one back or undo the accident, obtaining monetary compensation can help relieve the financial burden of your loss.
