Halloween Horror Hit-and-Run Incident in NYC

Q: Can I sue for personal injuries if someone intentionally hurts me?

Some kids come home on Halloween with a load of candy. Others with a personal injury lawsuit.

Halloween can be frightening and dangerous at times. Mischievous teens and bad judgment can be a recipe for disaster and the consequences can impact innocent people who may be in the wrong place at the wrong time.

In response to his vehicle being egged buy some teens, an apparently maniacal minivan driver reportedly sought revenge by mowing down a high school quarterback who witnesses claim had not even been involved in the egging which was done by a separate group of teens. Then, he reportedly "threw his minivan into reverse and ran over [the teen] again remarking “That's what happens!" before trying to run away. But the alleged hit-and-run driver was promptly caught and the teen miraculously survived albeit with "fractures to his skull, spine, pelvis and right leg" and lung damage. He reportedly lost his father last year, has a very long recovery road ahead of him, and will likely not play football again.

In order to prevail in a personal injury lawsuit, a victim must demonstrate that their injuries were caused by the negligent, reckless, or intentional actions of another person. Once liability is established, compensatory damages may be awarded for such things as current and future medical expenses, current and future lost income, property damage, pain and suffering, and more depending on the facts and circumstances of each case.

In the case of hand, the driver was reportedly charged with "attempted murder, assault, and leaving the scene of an accident." But a personal injury lawsuit is not dependent upon whether criminal charges are brought or sustained against a perpetrator.
