Policeman Injured on Way to Bronx Parade

Q: Can a police officer sue for personal injuries?

Being a police officer can be a dangerous job, even when you pull duty working the Bronx Columbus Day parade.

Bronx motorcycle accidents happen all the time. An on-duty NYPD officer on a two- wheeler scooter was struck by a car as he was attempting to make a routine turn. The impact reportedly caused the police officer to lose control and crash the scooter into the front of a large pick-up truck. Upon impact with the pick-up, the officer went airborne and landed on top of an SUV that was behind the pick-up truck. This one officer ended up having impact with three different vehicles--all larger than the scooter he was riding on.

The police officer reportedly sustained a devastatingly painful compound fracture to his left ankle which was allegedly described by another officer has “the worst break [he'd] ever seen”, prompting concern over his ability to walk again. The bone was crushed and the leg was cut open and exposed. The officer admirably secured his weapon and directed onlookers to stay safely on the sidewalk, according to witnesses, yet occasionally cried out in agony during the ordeal. The woman who hit the officer with her Mercedes remained on the scene.

In a personal injury lawsuit, someone who is seriously injured due to the negligent, reckless, or intentional actions or inactions of someone else can sue for compensatory damages. Once liability is established, recoverable damages may include the cost of current and future medical expenses, current and future lost income, property damage, pain and suffering, and more depending on the particulars of each case.

Each case is unique and presents certain challenges and considerations, including what damages what type of workers can sue a responsible third party for when they’ve been injured on the job. In addition, insurance and liability rules in New York are different for motorcycles than for automobiles. So, it’s important to see a skilled personal injury attorney as soon as possible after any accident and before accepting any insurance settlement.
