Homeless “Daredevil” Killed by Garbage Truck in Bronx

Q: Are all fatal pedestrian accidents automatically the fault of the driver?

When people hear about a fatal Bronx trucking accident involving a garbage truck and a pedestrian, they might assume the truck driver was at fault. After all, drivers are often guilty of distracted, aggressive, or impaired driving. And truck drivers are subjected to many additional safety regulations which might have been ignored. But each case requires an investigation into the behavior of all parties involved.

If the driver caused the pedestrian’s death by negligently, intentionally, or recklessly driving, the victim’s closest surviving family members may be entitled to damages through a wrongful death lawsuit.

Once liability has been established, compensatory damages may include the final medical and funeral expenses of the victim, loss of financial support that the victim provided to the survivors, and more, depending on the particular circumstances of each case and the survivor’s relationship to the victim.

Because a wrongful death lawsuit is very complex, a skilled personal injury attorney should be consulted to determine who, if anyone, has standing to sue and what damages they may be entitled to recover.

Recently, a privately-owned garbage truck reportedly ran over and caused the death of an allegedly homeless man. According to police, the "daredevil" jumped onto the step board on the passenger’s side of the garbage truck, grabbing the sideview mirror as the truck was rolling, but he “lost his balance and fell under the rear wheels". He reportedly died at the scene from massive head trauma. The driver, who stayed on the scene, was reportedly not charged.
