Chemistry Class “Fireball” Injures Four in Bronx High School

Q: Do schools have a duty to provide protective gear to students in lab classes?

Holy Bunsen burner!

A Chemistry experiment allegedly demonstrating how an atom goes from ground state to excited state got a little bit too exciting in one all-girls Bronx Catholic high school recently--raising questions as to whether a personal injury lawsuit related to the mishap may be forthcoming.

When the Chemistry class experiment went awry on the day before Thanksgiving, four sophomores-- who were allegedly not wearing protective gear--were injured by the resulting "large fireball".

Reportedly, the students were taken to the hospital, "three with burns, the fourth with respiratory-related issues" after the flame in the experiment… which allegedly did not involve hazardous materials…"got too large".

The nun in charge of the school reportedly claimed that the injuries were all minor--in contrast to the Fire Department reportedly classifying the injuries of two of the students as "serious".

At least one of the injured students’ parents immediately questioned why the students were allegedly not wearing protective gear such as lab coats, gloves, and safety glasses when conducting what was apparently a potentially dangerous experiment.

In order to prevail in a personal injury action, a victim must demonstrate that their injuries were caused by the negligent, reckless, or intentional actions or inactions of another person or entity.

Once liability is established, the victim may be entitled to compensatory damages for such things as current and future medical expenses, lost wages and anticipated diminished earning capacity, property damage, pain and suffering, and more, depending on the particular facts and circumstances of their case.

So, was the teacher, and consequently the school, negligent in failing to provide appropriate protective gear and/or to follow proper safety procedures during the experiment and, if so, did that cause serious injuries?
