New York City Teen’s “Wild Rampage” Leaves Pedestrian Injured

Q: Are criminal charges against a driver a prerequisite to a personal injury lawsuit?

It's tough to be a teen these days. It's even tougher to cross paths with a teen whose apparent angst shifted into overdrive, and caused a New York City car accident with a pedestrian jogger.

But that's what police say happened in Brooklyn when a teen reportedly went on a "wild rampage" that involved him driving three different cars – two of them allegedly stolen – – and crashing into the jogger and other vehicles before the one-day spree was finally stopped.

Because she was allegedly seriously injured by the negligent, reckless, or intentional actions of the driver, the injured pedestrian may be entitled to compensatory damages through a personal injury lawsuit. If the teen is found liable, the victim may be entitled to damages for items such as current and future medical or rehabilitative expenses, current and future lost income or diminished earning capacity, property damage, pain and suffering, and more.

According to authorities, the teen was involved in three separate incidents beginning with the early morning hit-and-run "ramming" of a female jogger on a bike path.  Less than three hours later the teen reportedly stole an unattended running vehicle and hit a police car and a parked car in an effort to avoid apprehension by police before running off on foot. In the third incident shortly thereafter, police say the teen stole another car but they were able to quickly apprehend him using the Find my iPhone app after the car’s owner told them she had left her cell phone in the stolen vehicle.

The teen, who reportedly also had two prior run-ins with the law in recent months, was charged with a multitude of criminal charges relating to this spree. The filing of criminal charges, and the outcome of same, has no effect on the victim’s right to pursue a personal injury action against him.
