When Police Misconduct Causes Injuries

Q: Can I sue an off-duty cop for personal injuries received?

While in the vast majority of cases, NYPD officers conduct themselves honorably and serve and protect the public well, New York police brutality and police misconduct lawyers sometimes see an uglier side of the shield. 
In fact, sometimes the behavior of police officers, whether on-duty or off-duty, can injure or kill people and result in a personal injury lawsuit or a wrongful death lawsuit, as the case may be. 
Recently, an off-duty NYPD Sergeant was "charged with resisting arrest, obstructing governmental administration, disorderly conduct and fleeing an officer in a vehicle". Reportedly, the off-duty officer initially "angrily refused" Sheriff’s officers’ requests to immediately move his double-parked car, then "struck a pedestrian and drove off" blowing a stop sign with officers in pursuit. When apprehended and being placed under arrest, he wildly kicked and flailed his arms and legs, according to authorities.
Lawsuits may arise when an officer acts outside of accepted police protocol and in a negligent, reckless, or intentional manner causing injury or death to someone else. An injured victim, or the surviving close family members of a victim who died from their injuries, can sue for compensatory damages. 
If liability is established, compensatory damages generally include the victim’s current and anticipated future medical expenses, current and future lost income, pain and suffering, and more. In the event of a death, the victim’s family may be able to recover the cost of the victim’s final medical expenses and burial expenses, the victim’s pain and suffering prior to death. In addition, depending on the family member’s relationship to the victim, they may be entitled to damages for loss of financial support and more.
