Alleged Molestation in a New York Ambulance

Is a sexual assault grounds for a personal injury lawsuit?

Imagine feeling sick enough to call an ambulance. When it finally arrives, there's a sense of relief that help is here, that the professionals will take care of you. That you are safe.

Now imagine that the ambulance doors close and the paramedic molests you. That's what one woman accused an on-duty FDNY paramedic of doing to her in a personal injury lawsuit.

The woman says the medic allegedly made lewd and boastful comments about his own genitalia then "grabbed her by the hair, pulled her down to the ambulance floor and forced her to perform oral sex on him". She allegedly reported the incident to hospital staff after her arrival.

The paramedic has been arrested and is reportedly facing "sex abuse, criminal sex act, forcible touching and official misconduct charges".

Regardless of whether criminal charges are brought or sustained, a victim who has suffered harm at the hands of another may be entitled to pursue a personal injury lawsuit. In order to do so, the victim must demonstrate that they suffered an injury as a result of the negligent, reckless, or intentional actions or inactions of another person or entity.

If liability can be established, compensatory damages may be awarded for such things as the victim’s current and future medical bills, current and future lost income, and compensation for physical and psychological injuries.

The time within which a person has to commence a personal injury action is limited, so it's important to consult a skilled personal injury attorney as soon as possible after the accident or incident. In cases that may involve suing the State of New York or a government agency or municipality, the time by which a victim has to serve a notice of claim may be as short as 90 days from the incident. Failure to timely file may result in dismissal of the action against the state, government or municipality so do not delay.
