Bronx Sanitation Truck Accident Claims Pedestrian’s Life

Q: Can a driver be sued for personal injuries if criminal charges aren’t filed against him?

A neighborhood reeling from a Bronx trucking accident involving a pedestrian last month is calling "garbage" upon recently learning that the sanitation truck driver who allegedly ran over and killed a beloved neighborhood man was reportedly responsible for running over and killing another man six months earlier. He was reportedly working for the same private sanitation company at the time of both fatal incidents.

Outraged community members are calling for accountability for the "reckless rubbage collector" who they feel should not have been allowed to drive after the first alleged incident. According to police sources, both incidents were considered "accidents" and no charges have been filed against the driver in connection with either incident though his commercial driver’s license is reportedly being revoked. He has also allegedly been suspended from his private sanitation company job.

Bronx personal injury attorneys can help victims and their families when they've been injured or killed as a result of the negligent, reckless, or intentional actions or inactions of another person or entity. If liability can be proven, the victim (or their closest surviving family members if they are killed in the accident), may be entitled to compensatory damages.

When the victim dies, compensatory damages in a wrongful death lawsuit by the family may include the victim’s final medical and funeral expenses and other physical or psychological injuries, and/or financial losses. The damages differ on a case-by-case basis and are based on the victim’s injuries as well as the victim’s relationship to the surviving family members. Generally, wrongful death actions are brought by the victim’s spouse, children, and/or parents. The civil wrongful death lawsuit seeking monetary damages may still be appropriate even if criminal charges are not brought.

If you or a loved one has been injured or loved one has been killed in an accident that wasn't your fault, the Goldstein Law Firm can help maximize the compensation to which you may be entitled. While we can't undo the accident, a lawsuit may help relieve the financial burden it has caused. Contact us today for a free consultation.
