Brooklyn Carwash Accident Claims Husband on Wedding Anniversary

Q: Are damages for a victim’s physical and psychological pain recoverable in a wrongful death action?

Most New York City car accidents happen while vehicles are traveling on the roadways—rather than in the carwash.

But a carwash accident can give rise to a personal injury lawsuit as well as a wrongful death action.

After surviving a career as a cop, a 90-year-old, retired NYPD police officer was killed in a freak carwash accident in Brooklyn ---but not before watching his wife of almost 65 years die first.

The couple’s car and another vehicle were reportedly involved in a “car accident” --inside the carwash--while on the conveyor belt. Once outside, while the elderly couple was reportedly standing behind their car inspecting the damage to the back of their vehicle, a carwash worker drove the other vehicle—an SUV--out of the car wash and allegedly hit the couple. Then, witnesses claim he “inexplicably” backed up and drove forward—allegedly striking the elderly woman once again and killing her. The husband was rushed to the hospital where he lingered until he died from his injuries a week later-- coincidentally on what would've been the couple’s 65th wedding anniversary.

A wrongful death lawsuit may be appropriate when someone has been killed as a result of the negligent, reckless, or intentional actions or inactions of another person or entity. If the closest surviving family members of a victim can prove liability for the death, they may be entitled to recover cover compensatory damages.
