New York Dog Bite Lawsuits

Q: Can I sue a dog owner for a dog bite injury?

The director famous for "Raging Bull" and many other movie blockbusters is involved in a new project that could be titled "Raging Terrier". But it's not a Hollywood film, it's a New York dog bite lawsuit for personal injuries allegedly caused by the director’s dog.

A former home nurse claims she was attacked in the director’s Park Avenue townhouse by what is believed to be the family's now-dead dog, Desmond. She accuses the director and his wife of negligently allowing the dog to "approach, menace, attack and bite" her and claims she was disabled and unable to work for about two years thereafter due to the bite attack injuries and neck and back injuries suffered while trying to escape.

The suit further alleges that the owners were aware of the dog’s “ferocious nature and…propensity to attack", but were nevertheless "negligent, careless, reckless and grossly negligent in the ownership… use and control" of the dog. The plaintiff claims she suffered "severe and permanent injuries…great pain, shock, and mental anguish."

The director’s family is reportedly vigorously defending the lawsuit which wasn’t commenced until more than two years after the alleged incident took place. In addition to denying any negligence or want of care on their part, and in addition to other defenses, the defendants’ claim any injuries the plaintiff may have sustained in the alleged incident were wholly or partially caused by the plaintiff’s own conduct.

In New York, the owner of a "dangerous dog" may be held strictly liable for injuries caused to others by their dog. Depending on the type of damages sought to be recovered related to a dog bite injury, the victim may need to prove the dog owner was negligent and failed to control or restrain the dog.

Defenses to dog bite claims include but are not limited to a dog biting a trespasser on its property, biting to protect its owner, or biting because it was provoked by the victim.
