Dancing Surgeon Sued for Malpractice

Q: What constitutes medical malpractice?

An online video of a dancing doctor has gone viral. Unfortunately, it was apparently taken during a cosmetic surgery procedure in an operating room. Not surprisingly, the state medical board wasn't impressed with the doctor’s alleged conduct. Neither were the nine patients who have reportedly sued the doctor for medical malpractice.

The dermatologist in the video, who allegedly claims she has the ability to "multitask" and denies wrongdoing, was suspended by the state medical board. The board reportedly deemed her conduct as “posing a threat to the public health, safety and welfare".

One video purportedly shows the surgeon waving a scalpel and “rhythmically” making incisions– – in essence, dancing while operating. A tenth patient – – one whose buttocks cosmetic surgery procedure was allegedly the subject of one of the doctor’s dance clips reportedly intends to sue for “pain and suffering". She claims the doctor should have paid more attention to operating on her instead of dancing and says "her buttocks are now lopsided and her left side is continually itching".

A personal injury lawsuit requires a victim to prove they have been seriously injured as the result of the negligent, reckless, or intentional actions or inactions of someone else. Medical malpractice actions fall within personal injury law.

To be found liable in a medical malpractice lawsuit, the injury to the patient must result from medical treatment that deviates from accepted standards of practice. The injury can come at the hands of negligent doctors, hospitals and other medical professionals. If the doctor is found liable for the patient’s injuries, the patient may be awarded considerable damages. Compensatory damages may include pain and suffering, as well as current and future medical bills and lost income.
