Model Sues Hotel for Bedbug Injuries

Q: Can I sue for bedbug bites?

Good night. Sleep tight. Don't let the bedbugs bite.

According to a Victoria's Secret model who filed a personal injury lawsuit for alleged physical and psychological damages, one hotel didn't take the last part of that famous phrase seriously enough.

The model claimed she was "massacred" by bedbugs in her hotel bed and that the physical damages of the bites covered nearly all of her body, caused reactions that required "extended treatment", and "negatively impacted her modeling career". In addition, she reportedly suffers psychological damages including nightmares, fear of bedbugs, shame, embarrassment, and humiliation from the bites and their impact on her modeling career.

In order to prevail in a personal injury lawsuit, a victim must establish that her physical and/or psychological injuries were a result of the negligent, reckless, or intentional actions or inactions of another person or entity. Once liability established, the victim may be entitled to compensatory damages for current and future medical treatment, current and future lost income, and other damages. Sometimes, a victim may also sue for punitive damages in a personal injury suit, which are intended to punish the defendant for particularly egregious actions and to deter them from allowing a repeat of the harm to occur to the victim or others in the future.

When you’ve been physically and/or psychologically injured due to no fault of your own, you need a skilled personal injury attorney will a track record of successful verdicts and settlements in your corner. An experienced attorney knows the long-term value of your claim and can not only evaluate whether an insurance company settlement offer is fair or not but can often negotiate a higher settlement figure than the one initially offered. If a suitable settlement can’t be reached, then litigation will be brought.
