Q: Who has standing to sue for wrongful death?

A New York automobile accident involving a limousine and pedestrians that claimed the lives of 20 people has been described as “the nation’s worst traffic accident in nearly a decade”.

Not only did all 17 passengers and the driver from the limousine die, but two pedestrians were also struck and killed. Several members of one family were in the limousine including four sisters and three of their husbands. The limousine was reportedly on the way to a birthday party for one of the sisters when it ran down a steep hill and off the road hitting two pedestrians and “slamming into a shallow creek bed” immediately killing all involved.

The devastation to the surviving family members of all involved—and the several little children left without parents—is almost too much to comprehend.

In the wake of in the accident, the limousine company operator was reportedly charged with criminally negligent homicide. According to investigators, initial reports indicated “the vehicle never should have been on the road, having failed two state inspections in six months, and the driver wasn’t properly licensed”.

When someone is killed as a result of the negligent, reckless, or intentional actions or inactions of another person or entity, their closest surviving relatives may be entitled to damages through a wrongful death lawsuit. Often, those relatives are the victim’s spouse, children, or parents.
