Some people love going out on New Year’s Eve. Others stay in, many preferring the safety of being home instead of out on the roads. After all, the holiday is known for widespread excessive drinking and celebrations that run into the wee hours of New Year’s morning--with an uptick in New York automobile accidents often caused by drunk or distracted driving.
As if to jinx things, only three days after New York Mayor Bill DeBlasio announced that New York City was “on pace to see its fifth year of declining traffic-related fatalities” what was likely the first New York City bicycle accident death of the New Year happened merely hours after midnight.
Reportedly, a 26-year-old man who’d been riding on an e-bike was found unconscious on a Brooklyn roadway. The man was reportedly killed after riding into the open door of a parked cab and then falling into the roadway where he was immediately struck by a moving car.
When a person is injured or killed due to the negligent, reckless, or intentional actions or failure to act of another person or entity the victim – – or their closest surviving relatives in the event of a fatality – – may be entitled to monetary compensation. If the victim sues, a personal injury lawsuit may be commenced to recover damages such as current and future medical costs, lost income, physical and emotional suffering, and more.
A wrongful death lawsuit may be commenced in cases where the victim dies so that their closest surviving family members can recover compensation for their losses. Wrongful death lawsuits are complex with regard to which relatives have standing to sue and for what type of damages they may be entitled to recover. Generally, the final medical and funeral expenses of the victim are recoverable as well as certain financial and other losses the victim’s family has sustained as a result of the victim’s death.
Not all accidents are grounds for a personal injury or wrongful death lawsuit, so it’s important to consult with a skilled personal injury attorney as soon as possible to help evaluate the sufficiency of any insurance company settlement offer and consider whether liability can be established.
