Can I sue for injuries in a dirt bike accident in New York?

New York automobile accidents can play out through so many different scenarios. They may involve traditional automobiles, tractor trailers, trains, motorcycles, bicycles, pedestrians, and more. Often, serious injuries or fatalities may result in personal injury or wrongful death lawsuits.

New York personal injury attorneys are skilled at evaluating claims and should be consulted before victims accept any insurance company settlement offer. Because insurance companies are in business to keep their costs as low as possible, initial settlement offers are very often considerably less than the value of the claim. Victims-- who may be in pain or hurting financially due to an inability to work—are often vulnerable to pressure to accept the first offer even if it isn’t adequate compensation for what could be long-term or even life-time medical care, lost income, and pain and suffering.

Motorcycle accident victims, bicyclists, and pedestrians often suffer serious injuries due to the lack of protection surrounding their bodies at the time of impact and may need a particularly generous compensation package or award.
There are significant differences in insurance and liability laws in New York with respect to automobiles and motorcycles. Unlike in automobile accidents, No-fault coverage for medical costs and lost wages does not apply to motorcyclists   Also motorcyclists may pursue claims for minor injuries that don’t reach the No-fault threshold which would apply to automobile accidents.

The Long Island and upstate New York areas, have seen an increase in accidents involving dirt bikes, quads, and all-terrain vehicles (“ATVs”) which are generally not street legal. Such accidents may involve collisions with motor vehicles, other ATVs, or single ATV crashes where passengers are injured. Recently, a rear passenger on a 17-year-old’s dirt bike was reportedly ejected and injured in a single vehicle crash in East Hampton. The driver reportedly fled the scene and was later arrested.
