Is the misdiagnosis of cancer medical malpractice?

Imagine being told by a doctor or hospital that you likely had kidney cancer and needed to have both of your kidneys removed because of it. In addition to mentally processing the life-threatening cancer diagnosis, imagine the end result of the surgery would mean four hours of dialysis three days a week for the rest of your life--unless a kidney transplant could be obtained.

Now imagine finding out-- after both kidneys were removed-- that the biopsy reports from before the operation showed “no evidence of malignancy”, allegedly meaning that the kidneys were both “mistakenly removed”. 

This allegedly happened to a patient who reportedly commenced a medical malpractice lawsuit prior to dying eight months after the allegedly unnecessary surgery. She reportedly died from cardiac arrest which her daughter claims resulted from very high potassium levels. Her family further claims the woman would be alive today had her noncancerous kidneys not been improperly removed.
