Are colleges liable for deaths on college grounds?

When parents send their children away to college, they hope they will grow, mature, explore, learn, and become adults in a safe college environment. At the same time, many parents secretly worry that their child could be injured or even killed on or off university property due to their own poor decision-making, hazing, sexual or other violence, or other unfortunate circumstances.

New York City personal injury and wrongful death attorneys know all too well what horrific scenarios college students may encounter. Right on the heels of the alleged murder of a young woman who got into a car she mistook for her Uber ride, came news of the death of a Fordham University student who had reportedly fallen 40 feet from the campus clock tower in the middle of the night.

Although the clock tower is reportedly “off-limits” and “supposed to be locked”, students interviewed tell stories of it being commonly known as a “rite of passage” that thrill-seeking students “find a way” into the bell tower.
At around 3 am, the student and her friends somehow got into the bell tower. She reportedly “fell through an opening in the stairs and plummeted 40 feet sustaining trauma to her head and body” and died. An investigation is continuing as to how the students gained access to the bell tower and how the student fell.

If someone is killed as a result of the negligent, reckless, or intentional actions or inactions of another person or entity, their closest surviving relatives may be entitled to commence a wrongful death lawsuit. Such lawsuits are very complex as far as who is entitled to sue and for what damages. So, seeing a skilled wrongful death attorney as soon as possible after the incident is advised.

Damages differ on a case-by-case basis but generally include the victim’s final medical and funeral costs, compensation for pain and suffering the victim endured before dying, and other damages.

If you or a loved one has been injured, or a loved one has been killed, in an accident or incident caused by someone else, the Goldstein Law Firm can help maximize the compensation to which you may be entitled. It won’t bring your loved one back or undo the accident but it may alleviate the financial burden of your loss, so you can focus on healing. Contact us today to schedule a free consultation.
