Who is responsible for a worker’s injuries in a house renovation accident?

What happens when you mix construction workers, a neat-freak house staff, a tall ladder, and a multibillionaire’s East Hampton home? You might get a New York personal injury lawsuit, especially if a shoeless worker fell from the ladder and was seriously injured. 

Reportedly, the project in the mansion involved installing automatic curtains in a private home gymnasium. The injured electrician alleges that house staff directed the workers-- verbally and through signage in English and Spanish--to remove their shoes and wear slippery blue booties on their feet so as not to dirty or damage the expensive wood floors. The plaintiff allegedly fell 8 feet off of the ladder “whacked his heel on a stationary bicycle and fractured discs in his spine”. He reportedly underwent surgery, will require future operations, is homebound and his life “changed completely” as a result of the fall.

A New York slip, trip and fall accident lies within the doctrine of personal injury law. One of the most challenging elements of the case is to satisfy the “notice” requirement-- meaning that the property owner either caused the dangerous condition, knew it existed but failed to remedy it, or should have known of the dangerous condition which caused the victim’s injuries. There is a duty to maintain property that other people enter upon in a safe condition, though the level of that duty can differ based on the status of the person entering the property—with the duty being greater for invited people than trespassers.
