Personal injury lawsuits arise from many different situations such as automobile accidents and slip and fall accidents. Sometimes your injuries may be so serious that you are not conscious or are too distracted in the moment to take note of the surroundings and circumstances of the incident that led to your injuries. However, keeping evidence is important if you’re able to do so.

That means documenting or photographing what happened at or shortly after the incident so it can be used as evidence if needed later. For example, in an automobile accident, what were the road conditions like, what was the weather, what happened and what was said by the parties involved. Or in a slip and fall accident, note whether there were railings on stairs, puddles or wet floors, warning signs or cones, poor lighting, etc.

It’s also important not to discuss the accident with anybody before speaking with an attorney. Getting witnesses’ names is fine, but nothing further. And whatever you do, don’t post on social media or talk to the insurance company.

Be sure to go to all scheduled doctor appointments and do not feel pressured to return to work if you are unable to do so due to your injuries. You could not only hurt yourself, but you could hurt your claim.

The best thing you can do to maximize the compensation to which you may be entitled for injuries sustained due to the negligent, reckless, or intentional actions of someone else, is to make that first phone call to an attorney. That doesn’t mean litigation will be necessary, but an attorney can evaluate your case and often negotiate a better insurance company settlement than the initial offer made.
