Q: Are Baby Sleeper Products Dangerous?

Countless products are recalled each day, generally following findings that they’re responsible for serious personal injury or and/or deaths of the number of people. When the victims are babies, the product recall gets a lot of media attention.

Dangerous and defective product lawsuits, sometimes referred to as product liability lawsuits, generally fall within the umbrella of personal injury law. When consumers buy a product, they assume it will be safe. 

Product liability cases generally fall into one of three categories: 

  • Design defect cases – These cases are where the product is inherently dangerous based upon its initial design. In these cases, each unit would be impacted. 
  • Manufacturing defects cases- These cases are where the design is fine, but the item was constructed deficiently during the manufacturing process. In these cases, the number of impacted units may not be universal, but rather may be limited to a certain run of production. 
  • Insufficient instructions or warning cases- In these cases, product manufacturers fail to provide sufficient instructions for proper use or warnings of potential, non-obvious hazards of the product’s use.

Recently, Fisher Price recalled 5 million of its Rock N’ Play infant sleepers “after more than 30 infant suffocation or strangulation deaths over the past decade have been linked to the product rolling over”. 

Now, the company has reportedly “proactively” recalled 71,000 units of the inclined sleeper accessory of its Ultra-Lite playard with inclined sleeper. While there have reportedly been no injuries or deaths associated with it, the recall was initiated “because infants can roll from their backs to their stomach on inclined sleep products, risking injury or death”.

In personal injury cases, the victim, has the burden of proving that their injuries were caused by the defendant’s negligent, reckless, or intentional actions or failure to act.
