NYC High School Science Lab Burn Injury Suit

Q: Is the City Responsible for Injuries in Public High School Science Experiments?

New York City personal injury attorneys are watching with interest the long-awaited jury trial in a lawsuit against the city and a high school chemistry teacher for injuries allegedly sustained in a lab experiment gone horribly awry.

The victim, a 16-year-old boy at the time, was allegedly engulfed in a fireball that erupted during a reportedly potentially-dangerous experiment according to witnesses. According to the lawsuit, the “Rainbow Experiment” was performed in an unvented lab, where no students were wearing recommended protective gear. Further, the suit alleges that the high school never passed safety videos it received to its teachers “warning that the rainbow demonstration posed a risk of severe injuries if performed”. 

The fireball erupted when the teacher reportedly “opened a jug of methyl”, releasing potentially flammable vapors that ignited--resulting in the victim “suffering third-degree burns on 30% of his body, including to his head, face, neck, torso and hands” leaving him with disfiguring scars and physical and psychological damages. His father reportedly did not recognize him when he first saw him in the hospital. Another student was also reportedly burned, but to a much lesser extent.

To prevail in a personal injury lawsuit, the victim must prove the defendant is liable for their serious injuries. If the defendant’s actions or inactions were negligent, reckless, or intentional, the victim may be entitled to collect compensatory damages for such items as current and future medical expenses, current and future lost income or diminished earning capacity, and physical and psychological damages. 

In addition to the physical pain and months of hospitalization and surgeries, the lawsuit claims the victim suffers emotional pain from the negative impact the disfiguration has had on his social life, including the challenges of making friends and the inability to experience a typical romantic or sexual relationship as he is now 21 years old.
