New York City Broken Sidewalk Injury Lawsuits

Q: Who is responsible for injuries related to dangerous sidewalk conditions?

New York City personal injury attorneys handle many claims related to people being injured or killed on residential and commercial properties throughout the city. Who is responsible for compensating injured victims is a multi-layered question and the answer changes on a case-by-case basis.

In general, the doctrine of premises liability covers slip trip and fall lawsuits. It provides that the owner and/or manager of residential and commercial property has a duty to keep their premises safe for those who enter upon it. So, if the owner knew or should’ve known of a dangerous condition and failed to promptly repair it or post warnings, they may be liable for damages caused to those are harmed by the dangerous condition.

New York City Sidewalk Rules

Broken sidewalks are a big problem in New York City and a common factor in many slip trip and fall lawsuit. Sidewalk accidents are governed by specific New York City laws. Accidents due to defects in sidewalks related to trees, tree wells and roots are the city’s responsibility. But in order to ultimately sue the city, a notice of claim must be timely filed--and the window to do so is only within 90 days, so it’s important to contact an attorney as soon as possible after the accident.

Recently, a father of three reportedly died eight months after tripping on a raised and broken cobblestone tree bed and hitting his head on a bus as he fell. His family is suing the city for wrongful death.

If the city is found liable, compensatory damages may include such things as the victim’s pain and suffering before dying, victim’s medical and funeral expenses, his lost wages and benefits before dying, the value of support and services the victim provided to his family members, and more, as determined on a case-by-case basis.
