Taking Legal Action Against the Church for Personal Injury

Q: Can a priest, parish, or archdiocese be sued for personal injury?

When we think about a personal injury lawsuit against a priest, parish, and the Archdiocese, the first thought that comes to mind are lawsuits regarding sexual abuse as they’ve consistently made national headlines frequently over the past couple decades.

But priests can find themselves in hot water under other circumstances as one man of the cloth—and his parish and archdiocese—recently experienced. Using the wrong words in certain situations may cause psychological issues.

What is the basis of a personal injury action?

A personal injury action arises when a victim has suffered physical and/or psychological harm as a result of the negligent, reckless, or intentional actions or inactions of another person or entity. If the victim can prove liability, they may recover compensatory damages.

Recently, the mother of a teenager who committed suicide sued the priest, parish, and archdiocese for damages reportedly suffered “when the priest questioned whether her son would go to heaven” in a homily that turned into a “message regarding suicide” at the boy’s funeral Mass. Committing suicide has long been considered a sin by the Catholic Church.

The boy’s parents reportedly made it clear at the time they met with the priest to plan the funeral service that he should “deliver a positive and uplifting message that celebrated the life of their son”. The family claims they were further devastated having to sit through the service on suicide and its potential impact on their son’s ability to go to heaven, on top of the already indescribable pain of losing their son.
