Lawsuits Arising from Death on a Cruise Ship

Q: Can you sue a cruise ship line for a heart attack death?

When people think of taking a cruise to Mexico, they likely imagine relaxing on beautiful beaches, throwing back tropical drinks, and enjoying all the available fun a cruise ship typically provides. They don’t think they or their companions may die from a heart attack.

Unfortunately, New York City wrongful death attorneys know that people die on vacation quite often. While some deaths can’t be helped and are merely due to natural causes, others can be blamed on the actions or inactions of cruise ship personnel.

What is the basis of a personal injury or wrongful death lawsuit?

When a person or entity has a duty of care and they breach that duty and as a result of that breach a victim is seriously injured or killed, they may be held liable for damages. When liability is established, compensatory damages can include such things as the victim’s current and future medical expenses, current and future lost income, and more. If the victim dies from their injuries, their closest surviving relatives may be entitled to damages. Who would be entitled to sue and for what damages would be determined on a case-by-case basis and is a complex process that can be explained best by a skilled wrongful death attorney.

Recently, a widow sued a popular cruise line over the death of her husband who suffered a fatal heart attack during their cruise vacation. The negligence suit alleges the cruise line “failed to check an unlicensed doctor’s credentials before the phony physician treated her husband who later died aboard one of the boats”. The husband reportedly went to the medical center “complaining of chest pain, stomachache, and profuse sweating among other symptoms” and was sent to his cabin to rest before being given permission to go on an on-shore excursion after which he suffered a fatal heart attack.

The suit alleges the man’s medical condition was “not properly or timely diagnosed or treated” and that his death was the “direct and proximate result” of the cruise line’s negligence.
