Making the Most of Your Consultation with a Personal Injury Attorney

Q: What can I expect from a free consultation with a personal injury attorney?

For some reason, people can feel intimidated by lawyers-- even though the lawyer is there to help them. When you add in the physical pain and the fear over their financial future that many victims of car accidents or other acts of negligence are suffering, it can compound that intimidation.

Preparing for a meeting with a New York personal injury attorney may help.

Things to ask an attorney during the initial free consultation

  • What fields of law do you specialize in? You should look for an attorney who is experienced in personal injury law first and foremost, if not exclusively.
  • Have you ever handled a case like mine before? Ask for the attorney’s track record of success. You probably won’t want to be their first case.
  • Are you able to handle my case? Be sure the attorney has the time and resources to devote to your case and isn’t already handling more cases than he has time for.
  • What will the fee be? State laws and area practices differ, but personal injury cases are generally handled on a contingency basis so you only pay legal fees if you settle or win. Be sure you understand the percentage the lawyer will earn if you win or settle.
  • When will the case be over? Every case is different and courts systems are notoriously slow, but an experienced lawyer will be able to give some general estimate as to how long cases like yours have taken so you’ll have some idea how long it may be before you might resolve the matter.
  • What is expected of me throughout the process and how much time can I expect to have to commit? How much time can I expect to take off for court appearances and doctor’s visits?
  • Do I have to pay the advanced costs if we lose? Firms typically lay out the out-of-pocket costs of the case and get reimbursed for them at the time of settlement. Examples include court filing fees, medical records fees, and fees for expert witnesses which could really add up. So, it’s important to know who is responsible for these costs if the case is lost.
  • Can I contact past clients for references? Jurisdictions differ on whether this is allowed, but reviews from past clients can be helpful when deciding who to hire. If you can’t speak to references, you may have to rely on the attorney’s track record of successes.
